Prior to the first meeting we will contact each party and/or their representatives to obtain information about the dispute and establish that they have the authority to settle. We would also agree the time required, a date and a venue and consider who should attend. Some parties have their legal advisors present but this is not essential.
 
An initial briefing by the mediator will often be followed by a short statement from each party on the situation as they see it. The parties then have separate meetings with the mediator to clarify objectives and explore options. The mediators will not disclose any information gained at those meetings to the other party unless given express permission to do so.
 
Disputes can engender intense feelings that can inhibit clear thinking. Our mediators are skilled at recognising the power of emotions, enabling parties to focus on common goals and negotiate a fair and workable settlement.
 
When a resolution is reached the parties work with the mediator to produce a legally binding written agreement.
 
Many mediations take place during one (often long!) day with one mediator. Complex situations require flexible responses. We often suggest that two mediators are involved, at no extra cost, to generate options and discuss strategies. We can also offer multiple, shorter sessions, allowing participants time for reflection and consideration before entering into a legally binding agreement.
 
Costs for a one day mediation (involving up to 5 hours preparation and 5 hours mediation) are £1,500 + VAT & expenses. These costs are divided equally between the parties and we require 50% of fee at the start the process and the remainder at the end of the mediation. Other options are costed on a pro rata basis.
